POOL PRO TRAVEL VOUCHERS

TERMS & CONDITIONS

1. General Terms and Conditions 

1.1.  Information on the promotion is set out in all communications regarding the Travel Voucher promotion ("Promotion") and form part of these Terms and Conditions. 

1.2.  By participating in the Promotion, each Customer fully and unconditionally agrees and acknowledges that these Terms and Conditions and the decisions of the Promoter on all matters relating to the Promotion are final and binding.

1.3.  Customers must be individual Pool Pro Customers who are eligible to participate in the Promotion as set out in these Conditions of Entry ("Customers"). 

2. Definitions

In these Terms and Conditions, the following words have the following meanings:

“Credit” means the value of the Travel Voucher awarded to the Customer;

“Customer” means a current Pool Pro Customer.

“Eligibility Requirements” means the eligibility requirements set out in Section 5;

“Pool Pro” means the Promoter trading as “Pool Pro”;

“Pool Pro Customer” or “Customer” or “Shop” means a registered business with an Australian Business Number that is a customer of Pool Pro, and that has agreed to participate in the Promotion and acknowledges and agrees to these Conditions of Entry;

"Promoter" is The Pops Group Pty Ltd (ABN 88 695 050 043), 10-12 Cairns Street, Loganholme Qld 4129;

“Promotion” is the Travel Voucher promotion.

“Promotional Period" for this Promotion is set out on the official letter each Customer has received regarding the Promotion;

“Target” means the monetary target value a Customer must reach in order to qualify for a Travel Voucher. A Target must be reached within a specific time period and consists of valid purchase amounts. Targets do not include GST.

“Travel Agent” means Flight Centre Business Travel.

“Terms and Conditions” means these terms and conditions as amended by the Promoter from time to time;

“Valid Purchase” refers to transactions which:

     (a)  Are the purchase of Products ordered from Pool Pro during the Promotional Period; and

     (b)  Have been paid for in full by the due date for payment, during the Promotional Period; and

     (c)  Have not been reversed or cancelled or returned.

3. Promotion

3.1 Selected Customers are offered a loyalty incentive scheme whereby a Customer must reach a specific monetary Target within a specific period of time. Customers are given an official Pool Pro letter which states the Target and the date range of the Promotion.

3.2 If a Customer reaches their Target within the specific date range, the Customer is awarded a Travel Voucher. The Travel Voucher is a credit with Pool Pro’s Travel Agent. The Travel Voucher specifies the credit amount.

3.3 Customers who receive Travel Vouchers must redeem the Travel Voucher through Flight Centre Business Travel (the Travel Agent) by contacting Brigid Hourigan.

3.4 Each Travel Voucher has an expiry date. Travel Vouchers cannot be redeemed after the expiry date set out on the Travel Voucher.

3.5 Travel Vouchers are not redeemable for cash or traveller’s cheques. Travel Vouchers cannot be used in conjunction with any other offer.

3.6.  No Travel Voucher is transferable. Each Customer who receives a Travel Voucher will accept the Travel Voucher ‘as is’ and acknowledges that the Promoter accepts no responsibility for any variation in the value of the Travel Voucher.  There will be no compensation in the event that Customers are unable to use all or part of the Travel Voucher.

4. Eligibility Requirements

4.1. Entry into the Promotion is open to a Pool Pro Customer who receives an official letter from Pool Pro regarding the loyalty incentive scheme for the Travel Voucher.

4.2 A Pool Pro Customer must also satisfy the following eligibility requirements:

(a)  is a resident of Australia and is over the age of 18 years or a registered corporation in Australia, and 

(b)  is for the Promotional Period and up to and including the date on which the Travel Voucher is finally awarded, a Pool Pro Customer; and

(c)  that makes Valid Purchase(s) during the Promotional Period set out on the Customer’s official letter; and

(g)  Each Customer has all current accounts within terms.

4.3.  Employees of the Promoter or the Promoter’s associated agencies or companies directly involved in the Promotion (as determined by the Promoter) and their immediate family members are ineligible to participate in the Promotion.

4.4.  Customers who qualify for a Travel Voucher will receive an official Pool Pro Travel Voucher with an expiry date and an individual Voucher Number.

4.5.  All valid claims for a Travel Voucher and entitlements will be met unless they involve fraud or ineligibility. The Promoter reserves the right, and by their entry into the Promotion each Customer consents to the Promoter exercising this right, to validate and check the authenticity of Customers and Travel Vouchers claims.

5. Customer Obligations

5.1.  As a condition of the Travel Voucher, all Customers must:

     (a)  Comply with all Terms and Conditions (including the booking and passage terms and conditions) of the Promotions Operator and vendors;

     (b)  Abide by all policy rules of the Boat, Venue, Accommodation, Airline, or any other vendor used in relation to redeeming the Travel Voucher;

     (c)  Ensure that they have a valid government issued photographic identification in the form required by any vendors - it is the Customer’s responsibility to ensure that they have acceptable identification in the form required;

     (d)  If required for travel, ensure that they have a valid passport in the form required by any vendor - it is the Customer’s responsibility to ensure that they have acceptable identification in the form required;

     (e)  Comply at all times to the directions of the Boat, Venue, Accommodation, Airline, or any other vendor used in relation to redeeming the Travel Voucher.

5.2.  It is compulsory for each Customer to effect and maintain adequate and valid travel and medical insurance covering, without limitation, accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation, personal liability and loss and damage to personal property. It is also recommended that the Customer covers cancellation, curtailment and loss of luggage.

5.3.  The Airline Operator, its staff and other parties, such as government agencies, may search a Customer and their luggage. It is a condition that each Customer agrees to allow such searches. The Airline Operator can deny boarding or disembarking of any Customer in possession of any weapons or illicit substances, or if the Airline Operator deems the Customer is not in a condition to travel safely.

6. Promoters Rights 

6.1.  The Promoter does not assume any responsibility for any products and services offered as prizes under, or purchased to participate in, the Promotion. The products are sold and services are provided solely by the relevant vendors, under such terms and conditions as determined by such vendors, and the Promoter accepts no liability whatsoever in connection with such products and services. The products and services have not been certified by the Promoter and under no circumstances shall the inclusion of any product or service in the Promotion be construed as an endorsement or recommendation of such product or service by the Promoter.

6.2. Except for warranties and conditions implied by law which cannot be excluded, the Promoter makes no representations or warranties, express or implied, regarding the quality or suitability of any prizes awarded under these Conditions of Entry. 

6.3.  In the event of a dispute, the Promoter’s decision is final and binding and no correspondence will be entered into.

6.4.  The Promoter’s decision in relation to any aspects of the competition is final and binding on every Entrant. No correspondence will be entered into by the Promoter with any Customer in relation to a decision of the Promoter whatsoever.

6.5.  The Promoter and its members, financial institutions, associated agencies and companies and their respective directors, officers, employees and agents, shall not be liable for any loss or damage, including for any personal injury suffered or sustained in connection with the Customer’s participation in the Promotion or the receipt or use of any part of any prize or, if the prize(s) includes travel, suffered during the course of the prize winning travel, except for any loss or damage which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law. 

6.6.  To the extent permitted by law, the Promoter and its associated companies and their respective directors, officers, employees and agents will not be responsible in any way whatsoever in respect of the following: (1) any amount spent by a Customer in the course of entering the Promotion or for correctness of the details of the Valid Transactions made; (2) technical failures of any kind including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, line failure or the malfunctioning failure or unavailability of any computer, server, cable, line, network, hardware, software, internet service or web site; (3) unauthorised human intervention in any part of the entry process of the Promotion, including but not limited to theft, destruction or unauthorised access to, or alteration of the Promotion; (4) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any entry that is late, lost, stolen, damaged or misdirected or otherwise not received.

6.7.  The Promoter, in its sole discretion, reserves the right to cancel, suspend, terminate or modify the Promotion and Travel Vouchers if fraud, technical failures, extreme weather conditions, venue-controlled cancellations or changes, or any other factor beyond the Promoter’s reasonable control adversely affects the Promoter’s ability to conduct the Promotion and Travel Vouchers as contemplated in these Terms and Conditions, subject to state regulation. 

6.8.  The Promoter reserves the right, in its sole discretion, to disqualify any Customer it finds to be tampering with the entry process or the operation of the Promotion or to be acting in breach of these Conditions of Entry or in breach of any law or to be acting in an unsportsmanlike, non-genuine or disruptive manner.  Any attempt by any Customer to deliberately cause damage or undermine the operation of the Promotion may be a violation of criminal and civil law and, should such an attempt be made, the Promoter reserves the right to seek damages from any such Customer, to the fullest extent permitted by law, in addition to disqualifying such Customer.

6.9.  The Promoter will use its best endeavours to provide the Travel Vouchers. If any of the Travel Vouchers are unavailable for whatever reason, the Promoter reserves the right to substitute the Travel Voucher for a prize or item of an equivalent value.

6.10.  The Promoter’s or a Customer’s failure to enforce any term of these Conditions of Entry will not restrict the relevant party from enforcing that or any other provision at a later time.

6.11.  The Promoter accepts no responsibility for any tax implications that may arise from the Travel Voucher or the use/redemption of the Travel Voucher.  It is the responsibility of each Customer to seek independent advice on the possible implications this may have on their own financial situation.

6.12.  Records of all entries become and remain the sole property of the Promoter.  If a Customer opts-in to receiving further communications from the Promoter and/or its affiliates, the Customer’s details, which may include name, address, email address and mobile phone number will be entered into a database and the Promoter and/or its affiliates may use those details to send future marketing materials to the Customer.  Except where prohibited by law, participation in the Promotion constitutes the Cusomer’s consent to the storage, use and disclosure of the Customer’s entry details as set out in these Conditions of Entry.

6.13.  Except where prohibited by law, participation in the Promotion constitutes a Customer’s consent to the Promoter’s use of the Customer’s name, likeness, opinions and address for: (1) any future promotional, marketing and publicity purposes in any media worldwide, without further payment or consideration or notice; and, (2) any disclosure of such information by the Promoter required by law; and, it is a condition of entry that in order to claim the Travel Voucher, Customers must agree to execute any necessary consents and releases to effect the foregoing.  

6.14.  Information collected pursuant to the Promotion from Customers is subject to the privacy policies of the Promoter, which can be found at www.poolpro.com.au and will be handled in accordance with all applicable privacy laws in Australia. 

6.15.  Any cancellation or modification to the Promotion will be notified on www.poolpro.com.au/travelvoucher.

6.17.  If all or any part of any term or condition contained in these Conditions of Entry is declared or becomes unenforceable, invalid or illegal for any reason, that term or provision (or part of that term or provision) will be deemed severed from these Conditions of Entry to the extent of the unenforceability, invalidity or illegality and the other terms and conditions will remain in full force and effect as if the offending term or provision (or part of that term or provision) had not been included in these Conditions of Entry.

6.18.  These Conditions of Entry will be governed by the laws of the State of Queensland, Australia and each Entrant agrees to submit to the non-exclusive jurisdiction of the courts of the State of Queensland, Australia.
